• Commission Terms of Service

Commission Information:
  - All Payments are made within PayPal in EUR €.
  - I work best when given artistic freedom. It is not a requirement.
  - The turnaround time for my commissions can range from 1 week to 2 months.
  - Commissioned artwork may vary from provided examples, as my art style fluctuates frequently.
  - All artworks come with a simple or transparent background.

Commission Terms of Service

you ("the Client")
affirm to have read and agree to be legally bound by the following Terms of Service listed below.Failure to abide by the Terms of Service may result in a rejected/cancelled adopt purchase with or without a refund, and/or a blacklist/public service announcement.Please note that these Terms of Service may be subject to change without prior notice.
These Terms of Service are in effect as of 10th of May, 2024.

Client Requirements:
  - You must have an SFW (free of anything considered sexual) reference sheet or flat colored image for the character(s) you want drawn for the commission.
  - Must be able to pay via PayPal.

1.0 The Buyer may not do any of the following with my art and/or design before/after purchase:
_{claim, use, edit, trace, steal, repost, redraw, reference or sell my art, characters and/or designs.
1.1 The Client may also not feed my art or designs into any AI, AI generator and/or NFTs.
1.2 The Client may also not train my art or designs for AI purposes.}2.0 I have the right to refuse and/or cancel the commission for whatever reason, with or without explanation.
_{2.1 I may or may not provide a refund, even if the Client cancels the trade themself.
2.1 The Client has the right to cancel the commission with or without explanation.
2.2 Refer to 3.0 for more info.}3.0 The amount of a refund is depended on, how much of the commission has been finished.
_{3.1 If I have not started with the Client's commission, they will receive a full refund within 30 days.
3.2 If I have started with the Client's commission, they will receive a partial refund within 30 days.
3.3 If I finished the Client's commission, they will receive no refund.
3.4 The starting progress that refund rules follow by, are determined by the labels on my Trello.
3.5 If the Client's commission has the "Mostly done" and/or "Completed" label on my Trello, the Client will not receive a refund.
3.6 The Client may not make any charge backs whatsoever for their commission. Any refunds are handled by the Artist.}4.0 Any Client listed on my personal blacklist, may not make use of my services for commissions and/or designs.
_{4.1 Any third-party may not commission and/or make use of my services for any individuals listed on said blacklist.
4.2 Refer to 2.0 for more info.}5.0 Commissioned artwork may vary from provided examples, as my artwork fluctuates frequently.6.0 The Client may not use the commissioned artwork and/or design for any commercial use, unless discussed with me beforehand.
_{6.1 Any commissioned artwork and/or design is intended for personal-use only by default.
6.2 The Client may request permission for using the artwork and/or design in a commercial use, and is bound to follow the base by base conditions given by the Artist for commercial use.
6.3 Commissions intended for commercial use will be charged more than personal/ non-commercial commissions. Said up-charge for commercial commission are negotiable.}

7.0 I retain the copyright to any of the work/commissioned artwork that I produce.
_{7.1 I may or may not upload the Client's commission and/or Work In Progess image on any social media, unless specifically mentioned by the Client during the commission process to keep the commission private.}8.0 The Client may not make any edits to the unfinished and/or completed commission.
_{8.1 The Client may print and/or crop the commissioned artwork for personal-use only.
8.2 Personal-use stops being personal-use, as soon as the Client offers a product containing commissioned artwork for purchase, prizes as contests and/or giveaways.
8.3 Any printing and/or cropping must have any watermarks still remain visible to the human eye.}9.0 Any non-listed usage of commissioned artwork must be discussed with me beforehand.10.0 The Client may not remove and/or edit any watermarks present on any commissioned artwork and/or designs.
_{10.1 Any watermarks must stay visible.}11.0 All prices may deviate from their listed amount, due to any factors of a commission.
_{11.1 Any changes after the sketch was approved may add extra fees, depending on the changes.
11.2 If the Client is unsatisfied with the finished commission, the Artist is willing to discuss and make minor edits, up to a maximum of 5 times after correspondence. Any desired major revisions (ex. reposing, colour scheme change, etc.) will require a extra payment be made by the Client, depending on the severity of changes.
11.3 During the approval of the sketch, the Client can request an unlimited amount of changes, and is encouraged to ask for any changes of the sketch.
11.4 Any additional characters that proceeds the amount of 1 character per artwork, will double, triple, ... the final price of a commission.
11.5 The complexity of a character may add extra fees, depending on the complexity determined by the Artist on a case by case basis.
11.6 Any characters that have been designed by the Artist, aka me SturmGeist/Simon, will grant a 25% discount upon commissioning a artwork of said design from me.}

12.0 The Client is expected to provide credit to me as the Artist of any commissioned artwork if commissioned artwork is used.
_{12.1 This includes but is not limited to: Profile Images, Prints, Backgrounds and/or any other personal uses.}13.0 The Client may be blacklisted if they do any of the following which includes but is not limited to:
_{Failing to pay on time, leaving the Artist without any responses (ghosting), immoral practices, failure to credit and/or fail to abide Terms of Service.}14.0 Payment is to be made after requested to do so by the Artist.
_{14.1 Any Payment is made via PayPal and in the currency EUR.
14.2 The Client has 48 hours to pay after having been requested to. Failure to pay within 48 hours will result in a temporary ban from my services for 1 week and their slot being opened for someone else.}15.0 Any commissioned artwork is strictly not allowed to be reposted and/or re-uploaded by the Client to any spaces on the internet, even if credit is given.
_{15.1 Any websites with the sole purpose of hosting characters (like Toyhouse) are an exception to this rule, IF credit is given to the Artist.}16.0 I do not work on a "first come first serve" basis.
_{16.1 The order date of a commission does not determined the work order of the Artist, meaning smaller/faster commissions could be finished before yours.}

17.0 Any commissioned artwork is strictly prohibited to be finished, edited and/or put into any AI or AI-like generators by the Client.
_{17.1 This includes using AI to complete sketches or work in progress images of a commission.
17.2 This also includes using AI and/or any tools to remove the background of a commission. The Client may also not do this themself by editing the image in any editing program.}18.0 Any commissioned artwork might be used by me as promotional material for my services and/or other uses.19.0 Any minors making use and/or purchasing my services are assumed to be have granted permission by their legal supervision.
_{19.1 I do not take responsibility if any minors make use and/or purchase my services without permission by their legal supervision.
19.2 Any cases like these do not have special refund conditions and still follow the normal refund conditions mentioned within 3.0 of this Terms of Service.}20.0 Any commissions that include a custom-made design by the Artist, follow the Artist's Design Terms of Service on top of this Commission Terms of Service.21.0 It is expected from the Client that they will read the Terms of Service on their own without having been asked to by the Artist.22.0 The Artist may use free to use and/or paid 3D models and/or images as references for commissioned artwork.23.0 Any requested material(s) may deviate in the commission from what was provided by the Client.

By offering on and/or owning a design, ("Adopt", "the Design"), created by
me, user @SturmGeist ("the Designer", "my", "me"),
you ("the Client", "the Owner", "the Buyer")
affirm to have read and agree to be legally bound by the following Terms of Service listed below."The Purchase", "the Trade" refers to the exchange from the Designer and/or a third-party, who previously owned the Designer's design, to the current Buyer.Failure to abide by the Terms of Service may result in a rejected/cancelled adopt purchase with or without a refund, and/or a blacklist/public service announcement.Please note that these Terms of Service may be subject to change without prior notice.
